Terms & Conditions - Digital Print Purchases
Print Exclusivity
All prints sold through this store are offered on an exclusive basis to one buyer per colourway.
Once a colourway has been purchased, it will be removed from the store and will not be sold again.
If a design is available in multiple colourways, those colourways may be sold separately unless the entire print family is purchased. Purchasing the full print family ensures complete exclusivity across all colour variations of that design.
File Delivery
Upon purchase, the buyer will receive one PNG file of the artwork.
Within 24 hours (weekdays), the buyer will also receive the editable source files and Pantone colour references via a secure transfer link sent to the email address used at checkout.
It is the buyer’s responsibility to ensure that the email address provided at the time of purchase is correct.
Colour Amendment Service
Buyers may purchase an optional Colour Amendment Service to customise the colour palette of a purchased print.
This service includes the creation of one additional colourway of the selected design tailored to the buyer’s requirements.
Following purchase, the designer will contact the buyer via email to discuss colour direction and requirements. The amended colourway will be delivered within 2–3 working days.
Upon completion, the buyer will receive all colourways associated with the design purchased (not including print families if these were not purchased), including the original and newly created version.
Colour amendments are considered a separate paid service and are not included in the original print purchase.
Refunds & Returns
Due to the digital nature of the products, all purchases are final and non-refundable once files have been delivered.
Usage Rights & Ownership
Once full payment has been received, the buyer is granted exclusive ownership and usage rights to the purchased design.
The buyer may use the design for unlimited production of end products, including but not limited to garments, accessories, textiles, and other physical goods.
However, the purchased design may not be resold, redistributed, licensed, shared, or transferred as a standalone digital file, either in its original form or modified.
The design must only be used as part of a finished end product.
Resale & Redistribution Restrictions
The buyer may not resell the design itself in any format, including:
Digital pattern libraries
Print-on-demand marketplaces selling the design file
Fabric or pattern resale platforms distributing the design file
Stock artwork or digital asset marketplaces
The purchase grants rights for end product manufacturing only, not resale of the design asset itself.
AI & Machine Learning Restrictions
Purchased designs may not be used to train, develop, or improve artificial intelligence systems, machine learning models, or generative design tools.
The artwork may also not be uploaded to datasets or platforms used for AI training.
Designer Portfolio Rights
The designer (Davina Hewitt / INA Studios) retains the right to showcase the design and resulting products within their portfolio, website, marketing materials, and social media only once the product has publicly launched.
All work will be shared in a positive and respectful manner that reflects the buyer and their brand appropriately.
Production Responsibility
INA Studios is not responsible for production outcomes once design files have been delivered.
Factors such as:
fabric selection
printing method
colour calibration
manufacturing processes
may affect the final result.
Buyers are responsible for conducting sampling and testing prior to full production.
Design Adjustments
If any technical errors in the design files are identified prior to production, the designer will correct these free of charge.
Requests for aesthetic adjustments, colour changes, or additional variations outside of technical corrections will be treated as additional services and will incur additional fees.
Limitation of Liability
INA Studios and the designer shall not be held liable for any loss, damages, or costs resulting from the use of the purchased design in production, manufacturing, or commercial sale.
This includes but is not limited to production errors, colour differences, or manufacturing losses.
Intellectual Property Protection
All designs displayed on the website remain the intellectual property of Davina Hewitt / INA Studios until purchased.
Unauthorised use, reproduction, copying, or distribution of designs without purchase constitutes copyright infringement and may result in legal action.
Right to Refuse Service
INA Studios reserves the right to refuse or cancel a purchase if misuse of designs, licensing violations, or suspected copyright infringement is identified.
